General Contract and Travel Conditions for Accommodation at “Chalets zum Ilsetal”, Mühlenstraße 19 in 38871 Ilsenburg/ Harz, operated by Schültke & Schültke GbR

1. Conclusion of the Contract

By submitting an online inquiry or an inquiry via email, the guest makes a binding offer to “Chalets zum Ilsetal” (hereinafter referred to as: Chalets) to conclude a contract. The registration is made by the registrant/booker also for all listed travel participants, for whose contractual obligations the registrant/booker is liable, as for their own obligations. If a third party has made a booking for a guest, they are jointly and severally liable to the Chalets along with the guest. The contract is concluded upon acceptance of the offer by the registrant/booker. The offer includes the rental price corresponding to the number of persons requested, as well as the final cleaning of the chalet and ancillary costs. If the content of the reservation confirmation deviates from the content of the inquiry/registration, the deviating content of the confirmation becomes binding for the guest and the Chalets if confirmed in writing.

To finalize the reservation for the guest, the Chalets request a down payment of approximately 25% of the booking value to the business account of Schültke & Schültke GbR, IBAN DE11 8006 3508 5101 0429 01 at Harzer Volksbank eG. Upon receipt of payment, the registrant/booker will receive a booking and payment confirmation from the Chalets. If the guest cancels after receiving the booking confirmation, they are not entitled to a refund of the down payment. Cancellations must always be made in writing. The remaining balance of the total price must be paid to the aforementioned account no later than 30 days before arrival, for which the guest will also receive a payment confirmation. If the guest cancels within 30 days before the arrival date, they are responsible for the full rental price as per the contract.

In case of non-utilization, the guest is also obliged to pay the full rental price as per the contract.

2. Granting of Use

The chalet will be provided to you in a clean and well-maintained condition for the period specified in the written booking confirmation.

Use is permitted only for the agreed number of persons as per the agreement. Subletting is not permitted. The beds are freshly made for the number of guests, and each guest receives a clean hand and bath towel from us.

The guest is obliged to treat the chalet and its furnishings with care and to leave it in a proper and broom-clean condition (empty trash cans, dispose of bottles and paper, unload or wash the dishwasher, remove ash from the fireplace). The guest will be held liable for any damages incurred, even if discovered after the guest’s departure. The place of performance is Ilsenburg, and the place of jurisdiction is Wernigerode.

3. Arrival and Departure

Three days before your trip, you will receive a “Bon Voyage” email from us with further information and a link for early check-in. If you have any issues with this, please send us your postal address, as well as the first and last names with dates of birth of all travel participants, via email for the issuance of your visitor’s cards within the registration system.

The chalet keys will be handed over to the guest by us or a team member in person, with an introduction, on the day of arrival between 3:00 PM and 5:00 PM.

Early Check-In: If you wish to arrive early and occupy your chalet, we can arrange this for you, by prior arrangement, from 1:00 PM for an additional charge of €40.

We kindly ask you to vacate your chalet by 10:00 AM on the day of departure. We will coordinate this again during the arrival formalities, or please contact us in good time using the aforementioned contact details.

Late Check-Out: If your chalet is still available on the day of departure, you can extend your vacation until 12:00 PM for €40.

4. Dogs & Smoking

Accommodating dogs in the chalet is only permitted with prior consent, and dogs must always be supervised by a person. Accommodating a dog in the chalet requires that it is well-behaved and house-trained. Guests must bring their own dog accessories.

Smoking of all substances, tobacco, and cannabis is prohibited in all chalets. If smoke odor or an unregistered animal is detected in the chalet, a basic cleaning fee of €200 will be charged.

5. Fiber Optic/WLAN Internet Connection

Upon request, we provide a free WLAN connection from Deutsche Telekom in our chalets. The registrant/booker assumes joint and several liability for themselves and all fellow travelers for the period of use. Should additional costs be incurred due to internet usage, these shall be borne exclusively by the guest and will be fully claimed.

Schültke & Schültke GbR assumes no liability for the topicality, correctness, completeness, or quality of the information presented. Liability claims against Schültke & Schültke GbR relating to material or immaterial damages caused by the use or non-use of the information presented or by the use of incorrect or incomplete information are fundamentally excluded.

The surfing speed depends on Deutsche Telekom. The landlord assumes no responsibility/liability for damages in this regard. Internet outages on the part of Telekom are not the responsibility of the landlord and cannot be remedied on weekends and public holidays.

6. Liability

Should disruptions or defects occur in the services of the Chalets, the Chalet will endeavor to remedy them upon immediate notification by the guest. Irrespective of §§ 701 et seq. BGB (German Civil Code), the Chalets are only liable in cases of intent or gross negligence. Safekeeping requires an express agreement. Offsetting, reduction, or retention are only permissible for the guest in the case of undisputed or legally established counterclaims. Any liability of the Chalets – apart from §§ 701 et seq. BGB – is limited in amount to the agreed lodging price. The limitation period for all claims by the guest is 6 months. In cases of force majeure (e.g., fire, water damage, strike, etc.) or other impediments for which the Chalets are not responsible (e.g., damage to reputation), especially those outside the sphere of influence of the Chalets, the Chalet reserves the right to withdraw from the contract without the guest/customer being entitled to claims, e.g., for damages. The guest is liable to the Chalets for damages or losses that occur during the contract period.

No further agreements will be concluded between the contracting parties. Corresponding changes to the contract, additions, and extensions require written form to be valid.
